What is a dual agency?

Dual agency is a situation in which a single real estate agent represents both the buyer and the seller in a transaction. Dual agency can be controversial, as it may create a potential conflict of interest for the agent, as they have a duty to advocate for both parties. Dual agency is not allowed in all states, and it may be subject to additional disclosures and regulations. In cases of dual agency, it is important for both the buyer and the seller to be aware of the potential for a conflict of interest and to seek the advice of independent counsel if necessary.
